01Who operates this site

This website is published and operated by Wincasa LLC, trading as Wincasa Properties, a licensed real estate brokerage in Dubai, United Arab Emirates. In these terms, "Wincasa", "we" and "us" refer to Wincasa LLC.

By using the site you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the site. We may change these terms from time to time; the version published at the date shown above applies to your use.

02Our relationship with the developer

The projects presented on this site are developed by Binghatti. Wincasa markets those projects as an authorised sales partner. Wincasa is an independent company: it is not part of Binghatti, does not build, own or manage the developments, and does not speak for the developer.

This is not the official website of Binghatti. Binghatti has not reviewed the content of this site, is not responsible for it and is not a party to any enquiry you make through it. Statements on this site about the developer's track record, milestones and figures are drawn from the developer's own published material and are labelled as the developer's.

Binghatti and the project names, renderings, photographs, plans and marks shown on this site belong to Binghatti and appear here under the terms of our sales partnership solely to market the developments. Nothing on this site grants you any right to use them.

03What the site is for

The site exists to give prospective buyers an overview of Binghatti developments that Wincasa markets, and to let them contact Wincasa for current information. It is a marketing and enquiry tool. It is not a booking platform, a reservation system or a marketplace, and nothing you do on the site reserves a unit or creates a contract to buy one.

04Prices, availability and project information

All prices, starting prices, unit mixes, sizes, payment plans, completion dates, amenities, distances and other project details on this site are indicative. They are supplied by the developer, change at each release and may already have changed by the time you read them. A published starting price refers to the lowest-priced unit type at the time of publication and does not mean that such a unit is currently available.

Images are computer-generated artist impressions or photographs of show units and may differ from the finished building, its finishes, views and surroundings. Floor plans and areas are approximate and subject to the developer's final drawings and the Dubai Land Department's registered plot and unit data.

Before making any decision you must confirm the current price, availability, payment plan, completion date and specification with your Wincasa consultant and read the developer's reservation form and sales and purchase agreement. Those documents, not this website, govern any purchase.

05No offer, no advice

Nothing on this site is an offer capable of acceptance, a promise that a unit will be available at a stated price, or a guarantee of rental yield, capital growth, service charge levels or completion on a stated date. Any figures about returns are illustrations based on stated assumptions and are not predictions.

Content on this site is general information only. It is not financial, investment, legal, tax or immigration advice, and it does not take account of your circumstances. Property values can fall as well as rise, off-plan purchases carry construction and timing risk, and currency movements affect buyers paying from abroad. Take independent professional advice before committing funds.

06Enquiries and communications

When you submit an enquiry form, request a brochure, ask for a call back or contact us on WhatsApp, you ask Wincasa to contact you about the projects we market. You confirm that the details you give are accurate and are your own, and that you have read the Privacy Policy. Enquiries are received by Wincasa, not by the developer.

We aim to respond within business hours on the same day but cannot promise a response time. We may decline to act on an enquiry that appears automated, abusive, fraudulent or unrelated to our services, and our server limits the number of submissions from a single connection to protect the service.

Brochures, price lists and floor plans we send you are provided for your personal evaluation of a possible purchase. They remain the property of the developer or Wincasa and must not be republished, resold or used to market the project without written permission.

07Reservations and purchases

A unit is reserved only when the developer accepts a signed reservation form and the reservation payment. A purchase is concluded only when both parties sign the developer's sales and purchase agreement and the sale is registered with the Dubai Land Department. Off-plan sales in Dubai are registered in the Land Department's interim register (Oqood) and purchase instalments are paid into the project's Land Department-regulated escrow account.

Wincasa's role in that process is that of a broker and authorised sales partner: we introduce you to the developer, assist with paperwork and coordinate with the developer's sales administration. The developer, not Wincasa, is the seller and is responsible for construction, handover, defects and the terms of the sales and purchase agreement. Wincasa receives its commission from the developer; unless we tell you otherwise in writing before you reserve, you pay Wincasa no fee for our brokerage services.

Government fees, including the Dubai Land Department registration fee, Oqood fee, trustee fees and any service, utility connection or community charges, are payable in addition to the purchase price as set out in the developer's documentation.

08Intellectual property

The text, layout, design, code and Wincasa's own brand assets on this site belong to Wincasa LLC. Developer content is covered by the section above. You may view the site and print or download extracts for your personal, non-commercial use in considering a purchase. You may not otherwise copy, reproduce, scrape, frame, republish or commercially exploit any part of the site without our prior written consent.

09Acceptable use

You agree not to:

• Use the site or its forms to send spam, marketing, bulk or automated submissions, or content that is unlawful, abusive or misleading.
• Attempt to gain unauthorised access to the site, its hosting environment, its enquiry log or any connected system, or to test their security without our written permission.
• Introduce malicious code or use bots, scrapers or similar tools to extract content or data from the site.
• Impersonate another person, misrepresent your relationship with Wincasa or the developer, or submit another person's details without their permission.
• Use anything on the site to market the developments as, or on behalf of, Wincasa or the developer.

10Third-party links and services

The site links to the developer's website, to WhatsApp and, where configured, to map services and our social profiles. Those sites and services are operated by third parties under their own terms. We do not control them, do not endorse their content and are not responsible for anything that happens on them. Conversations on WhatsApp are carried by Meta Platforms under WhatsApp's terms and privacy policy.

11Availability of the site

We try to keep the site accurate and available, but we provide it "as is" and "as available". We do not promise that it will be uninterrupted, error-free, secure or free of viruses, that its content is complete or current, or that it will meet any particular need. We may change, suspend or withdraw any part of the site at any time without notice.

12Limitation of liability

To the fullest extent permitted by law, Wincasa LLC, its owners, employees and agents are not liable for any loss or damage arising from your use of, or inability to use, this site or its content, including loss of profit, loss of opportunity, loss of data or any indirect or consequential loss, whether in contract, tort or otherwise, even if we were told it might occur. In particular, we are not liable for decisions you make in reliance on indicative prices, availability, completion dates, images or other project information shown on the site rather than on the developer's contractual documents.

Nothing in these terms excludes or limits liability for fraud, for death or personal injury caused by negligence, or for any other liability that cannot be excluded under the laws of the United Arab Emirates. Nothing in these terms limits any duty Wincasa owes you as a licensed broker under Dubai real estate regulations in relation to a transaction you actually enter into.

13Your responsibility

You are responsible for the accuracy of the information you submit to us and for any loss we suffer because that information was false, misleading or supplied without the authority of the person it concerns. You are also responsible for complying with the laws that apply to you, including any rules on buying property abroad or moving funds from your home country.

14Privacy

Our Privacy Policy explains what personal data we collect through the site, why, who sees it and for how long, and how you can exercise your rights. It forms part of these terms.

15Governing law and disputes

These terms, and any dispute or claim arising from your use of this site, are governed by the federal laws of the United Arab Emirates as applied in the Emirate of Dubai. The courts of Dubai have exclusive jurisdiction, without prejudice to any mandatory consumer protection you enjoy in the country where you live.

Any reservation or purchase you enter into is governed by the developer's reservation form and sales and purchase agreement, which contain their own governing law and dispute provisions and take precedence over these terms in relation to that transaction.

16General

If any part of these terms is found to be invalid or unenforceable, the rest continues to apply. Our failure to enforce a term is not a waiver of it. These terms and the Privacy Policy are the whole agreement between you and Wincasa LLC about your use of this site; they do not affect any separate written agreement about a transaction. These terms are written in English; if a translation is provided, the English text prevails.
